The terms DUI (driving under the influence) and DWI (driving while intoxicated) are often used interchangeably, but they’re treated as very different offenses in the State of Maryland. While these charges both loosely refer to the act of drunk or drug driving, they each carry different penalties and levels of severity. They also require very different approaches to defense.

Understanding Drunk Driving Laws In Maryland

The severity of a DUI/DWI will depend on everything from whether or not this is your first offense, to your BAC level, and the circumstances surrounding your arrest. While DUIs typically carry more severe penalties, both offenses can result in jail time.

For first-time offenders, drunk driving laws in Maryland can result in penalties as follows -

  • DWI:
    • Maximum 6-month license suspension
    • Fines up to $500
    • 8 points on your driving license
    • Up to 60 days in jail
  • DUI
    • 6-month revocation of driving license
    • Fines up to $1,000
    • 12 points on your driving license
    • Up to 1 year in jail

If this is your second or third offense, you could face as long as two years in jail, as well as a $2,000 fine. Equally, individuals who have committed four or more offenses could face as long as ten years of jail time for both DUI and DWI offenses.

License Suspension Procedures in Maryland

  • Test refusal: 270-day suspension for first offenses, 2-year suspension for second or third offenses.
  • Test failure 0.08 to 0.15 percent: Standard 180-day suspension
  • Test failure at 0.15 percent or over: 180-day suspension for a first offense, 270-day suspension for a third or second offense.

What Does ‘Actual Physical Control’ Mean?

In Maryland, you can be charged with a DUI, even if you aren’t actively driving at the time. To gain a conviction, police simply need to prove that you had ‘Actual Physical Control’ while in a vehicle and intoxicated.

You’ll naturally be confused if you’ve received a DUI simply from sitting in a parked vehicle, but a conviction is still possible if –

  • You were sitting in the driver’s seat
  • You were holding the keys to the vehicle
  • The car was running/the headlights were on
  • You were illegally parked

Police will also need to provide compelling evidence for a conviction that might include:

  • Intent to Drive
  • Impairment
  • Where your car was parked (e.g. privately/illegally or on a public road)

Potential Defences for DUI/DWI Charges in Maryland
